Terms & Conditions

By booking a photography session with Shelby Vilate Studios ("we", "us", "the Photographer"), you ("the Client") agree to be bound by these Terms and Conditions. Please read them carefully before confirming your booking. These terms form a legally binding agreement between you and Shelby Vilate Studios (ABN 86 570 632 160).

A non-refundable deposit of $100 AUD is required to secure your session date and time. No booking is confirmed until the deposit has been received.

The deposit is strictly non-refundable. In the event that you cancel your session, the deposit will not be returned regardless of the reason for cancellation. This deposit compensates us for the time set aside for your session and the opportunity cost of turning away other bookings.

A signed contract is required before payment of the deposit. By signing the contract you confirm that you have read and agree to these Terms and Conditions in full.

The remaining balance of your session fee is due no later than 48 hours before your scheduled session. We will send you a payment link via email at least 14 days prior to your session date as a courtesy reminder.

Payment may be made via:

• Secure online payment link (credit card or debit card, powered by Stripe — a 2% surcharge applies to cover processing fees).
• Direct bank transfer (BSB and account number provided on request — no surcharge applies).

If full payment has not been received 48 hours before the session, we reserve the right to cancel the booking without refund of the deposit.

If you need to cancel your session, please notify us as soon as possible by emailing bookings@shelbyvilatestudios.com.au.

• More than 48 hours' notice: The deposit is forfeited and no further charge applies. Any remainder already paid will be refunded in full within 5–7 business days.
• Less than 48 hours' notice: The full session fee is payable. If the remainder has not yet been paid, an invoice will be issued for the outstanding amount.
• No-show: The full session fee is payable, as above.

We understand that life with a newborn is unpredictable. If exceptional circumstances arise (e.g. medical emergency, hospitalisation), please contact us as soon as possible and we will do our best to work with you.

We understand that newborn sessions are time-sensitive. If you need to reschedule, please give us as much notice as possible. We will make every effort to accommodate a new date within the optimal session window for your baby.

One complimentary rescheduleis offered per booking, provided more than 48 hours' notice is given. Any subsequent rescheduling requests may attract an administration fee of $50 AUD.

Rescheduling requests made with less than 48 hours' notice will be treated as a cancellation and the cancellation policy above will apply.

Newborn sessions typically run for 3–5 hours to allow adequate time for feeding, settling, outfit changes, and parent/sibling portraits. We do not rush our sessions — your baby sets the pace.

Session packages include the services and number of edited images as specified at the time of booking. Additional edited images beyond your package inclusions may be available for purchase separately.

By proceeding with your booking, you grant Shelby Vilate Studios a non-exclusive licence to use images from your session for the following purposes unless you specifically opt out in writing:

• Portfolio display on our website and social media platforms (Instagram, Facebook).
• Marketing and promotional materials (both digital and print).
• Entry into photography competitions or professional development submissions.

We will never share images that identify your baby's full name, date of birth, or home address without your explicit written consent. You may request that we not use your images for any commercial purpose by notifying us in writing before or at the time of your session.

All photographs remain the intellectual property of Shelby Vilate Studios. You are granted a personal-use licence for the images included in your package. You may print, share on personal social media, and use them for your own non-commercial purposes. Resale, commercial use, or supply to third-party businesses is not permitted without prior written consent.

Edited images will be delivered via a secure online gallery within 4–6 weeks of your session date. You will receive an email notification when your gallery is ready. Gallery access links expire after 60 days — please download your images promptly. We are not responsible for images that are not downloaded before the link expires.

Shelby Vilate Studios takes every precaution to ensure the safety and comfort of all clients, particularly newborns. All posing is performed with your baby's safety as the absolute priority. All props, wraps, and studio equipment are sanitised between sessions.

In the rare event of equipment failure, data loss, or other circumstances beyond our control that result in loss of images, our liability is limited to a full refund of the session fee paid. We strongly recommend that clients retain all original downloaded files as we do not guarantee long-term storage of your images.

We accept no liability for any indirect, consequential, or special loss or damage arising out of or in connection with the services provided.

Our studio is located at 52 Rialto St, Coorparoo QLD 4151. All studio-based newborn sessions take place at this address.

We offer limited in-home and outdoor sessions within the Brisbane metropolitan area (approximately 50 km from Coorparoo). Travel fees may apply for locations outside this range. Any travel fee will be agreed upon in writing before your booking is confirmed.

If your baby, any siblings, or any attending adults are unwell on the day of the session, please contact us as soon as possible to reschedule. We ask that you do not attend our studio with symptoms of infectious illness. Our studio is a space shared by vulnerable newborns and the safety of all clients is paramount.

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Queensland.
